Method of Calibration

The method and standard to be used by RTS in the calibration of the equipment submitted by the customer (“Equipment”) shall be discussed and agreed between the customer and RTS. In the absence of any written instructions to the contrary, the customer is deemed to have agreed and accepted the standard used by RTS in the calibration of the Equipment. RTS shall state in the report the calibration method adopted for the Equipment tested.

Warranties

In carrying out the calibration, RTS warrants that it has exercised reasonable care and diligence in performing the tests, inspections, or calibration but no other warranties, implied or otherwise, is given with respect to RTS’ test results, services, or facilities.

In providing the test report, RTS does not in any way imply the suitability of the Equipment for their intended use. The customer shall determine the suitability of the Equipment, tests, or specimens for their intended use. RTS shall in no event be liable for any direct or indirect, special, or consequential damages.

Use of Results and Reports

The results of calibration performed by RTS apply to the particular Equipment at the time of its test. They do not indicate or imply that it is applicable to other similar items.

Unless otherwise expressed in writing, the test report does not indicate or imply that RTS approves, recommends, or endorses the manufacturers, the suppliers, or the users of such Equipment or specimens, or that RTS in any way, warrants the Equipment’s performance after calibration.

Loss and Damage

RTS shall not be liable for, and the customer shall indemnify and hold RTS harmless against any claim by or loss or damage to any person or property directly or indirectly occasioned by the Equipment.

RTS shall not under any circumstances whatsoever be liable for any loss or for any consequence of any such loss arising out of any cause whatsoever or any malfunctioning of or defect in or failure of the Equipment.

Lien

In addition to any right of lien to which RTS may be entitled to by law, RTS shall be entitled to a general lien on all Equipment of the customer in their possession for the unpaid price of any goods or services sold or rendered to the customer or any other moneys owing by the customer to RTS upon this or any other contract.
